The statute also creates a focused removal path. When the terms are met, the agency must remove the post within 14 days.
This rule concerns law-enforcement social media. It does not declare every booking photo confidential, determine every FOIA request, or control each private publication. No West Virginia anti-pay-to-remove statute was located in the official-code review. That finding should remain narrow.
Fayette Expungement Reaches Photographs
West Virginia expungement can reach much more than a docket caption. Under §61-11-25, the covered records expressly include arrest records, fingerprints, photographs, index references, and electronic or documentary data. When the court grants relief, it seals its material, directs other agencies to expunge covered records, and requires agencies to certify completion within 60 days.
